Interception of Communications in Albania

Constitutional and Statutory Framework

The Constitution of Albania guarantees fundamental human rights and freedoms, including freedom of expression (Article 22), right to information (Article 23), freedom and secrecy of correspondence or any other means of communication (Article 36), and inviolability of the residence (Article 37). Article 17 of the Constitution requires that any limitation to these rights must be established by law, in the public interest or for the protection of the rights of others, and should be proportionate.
