Confidentiality Agreement between Single Resolution Board and Bank of Albania

Effective [Date], the Single Resolution Board (SRB) and the Bank of Albania have entered into a confidentiality agreement to facilitate cooperation and information exchange in relation to the resolution of banks.

Terms of the Agreement


Under the terms of the agreement, the SRB may disclose confidential information to certain National Resolution Authorities listed in Annex B on a need-to-know basis. The disclosure will be subject to the condition that the recipient authority agrees not to further disclose the information, except to other persons listed on Annex B or as authorized by the SRB.

Assurance and Confidentiality


The SRB has obtained assurance from each National Resolution Authority receiving confidential information that it will maintain professional secrecy and only use the information for the purpose of resolving banks. The SRB will also inform the Bank of Albania on a regular basis of any requests made to disclose confidential information and the information shared as a result.

Duration of Cooperation


The agreement provides that cooperation under its terms will commence immediately and continue indefinitely, subject to modification by mutual consent or discontinuation by an Authority with 30 days’ advance written notice. The confidentiality provisions will continue to apply to any information provided prior to discontinuation.
