Saint Lucia has taken a significant step in its fight against criminal activity by strengthening its asset forfeiture and confiscation laws. The revised legislation gives law enforcement agencies greater powers to seize illegal assets, disrupting criminal networks and depriving them of their ill-gotten gains.
New Measures Empower Law Enforcement Agencies
The new measures aim to streamline the process of seizing illegal assets, making it more difficult for criminals to hide behind complex legal structures. Under the revised laws:
- Property Forfeiture: Property forfeited by court order will now vest absolutely in the Crown, allowing authorities to take control of ill-gotten gains.
- Provisional Vesting: Registrable property such as land and buildings will be provisionally vested in the Crown until registration requirements are met. The Attorney General will then have the authority to execute necessary instruments to register the Crown as owner.
Safeguards Introduced to Prevent Illegal Disposal of Forfeited Assets
The new laws also introduce a critical safeguard to prevent criminals from disposing of forfeited property without court approval:
- Court Approval: The disposal of forfeited property is prohibited without court approval before an appeal deadline has passed.
- Disposal Authority: After the appeal deadline, the Attorney General will have discretion over how to dispose of the assets, which can be used to fund crime-fighting initiatives or returned to victims of crime.
Definition of Registrable Property and Relevant Appeal Date
The revised legislation defines registrable property as land and buildings whose title is transferred by registration under the Land Registration Act. The “relevant appeal date” is determined by when an appeal against a conviction or forfeiture order has expired or been finally disposed of, whichever is later.
