Kampala, Tanzania - Guidelines Issued to Prevent Fraud in the Public Sector
The Tanzanian government has issued guidelines to public sector entities (PSEs) on developing and implementing fraud risk management frameworks to prevent the misuse of office for personal gain. These guidelines aim to complement existing laws and regulations aimed at preventing fraud in the public sector.
Defining Fraud
Fraud is defined as “any intentional act or omission designed to deceive others, resulting in the victim suffering a loss and/or the perpetrator achieving a gain.” The guidelines highlight three key types of occupational fraud:
- Asset Misappropriation: Theft or misuse of PSE assets
- Fraudulent Financial Statements: Falsification of financial records to obtain improper benefits
- Corruption: Illegal gratuity, extortion, bribery, and acceptance of “kickbacks”
Factors Contributing to Fraud
The guidelines emphasize that fraud is often committed due to a combination of three factors:
- Motivation: Greed or need
- Opportunity: Weak internal control systems and poor security over organizational property
- Rationalization: The philosophy that if others are doing it, why not me?
Warning Against Using Office for Personal Gain
The government has warned public servants against using their offices for personal gain, emphasizing the importance of ethical conduct and adherence to existing laws and regulations. The guidelines also emphasize the need for PSEs to establish effective internal control systems to prevent fraud.
