Gibraltar Takes Bold Step Against Corruption with Anti-Bribery Authority Bill

The Government of Gibraltar has introduced a landmark bill aimed at establishing an independent Anti-Corruption Authority, marking a significant milestone in the country’s drive towards greater transparency and accountability.

A Robust Regulatory Framework

The proposed legislation is designed to create a robust regulatory framework that will hold public officials and individuals accountable for corrupt conduct. The new authority will have the power to investigate any corrupt activity listed in its Schedule, including:

  • Fraud by abuse of position
  • Bribery
  • Misconduct in public office
  • Cheating the public revenue

Notably, the authority’s jurisdiction extends to investigating corruption that occurred at any time prior to the law’s commencement, regardless of whether the perpetrator was a public official.

Protecting Whistleblowers

The Bill also includes measures to protect whistleblowers who assist the authority with investigations. These measures ensure:

  • Employment security for whistleblowers
  • Penalties against those who fail to comply with reporting requirements

Government Commitment

Justice Minister Samantha Sacramento MP hailed the move as a major step forward in Gibraltar’s fight against corruption, saying: “Our Government has made significant strides in implementing reforms to increase transparency and accountability. I am pleased that we can now progress this important commitment, which will help to strengthen our anti-corruption structures.”

Chief Minister Fabian Picardo KC MP emphasized the significance of the Bill, noting that it is part of a broader effort to reform standards in public life: “This Government has always been committed to delivering greater transparency and accountability. The publication of this Bill marks another milestone on this journey, and we look forward to working with Opposition parties to refine the legislation further.”

A Crucial Step Forward

The proposed Anti-Corruption Authority is expected to play a crucial role in combating corruption in Gibraltar, helping to ensure that public officials are held accountable for their actions and that the country’s reputation remains untarnished.

This bold step forward demonstrates the Government of Gibraltar’s commitment to eradicating corruption and promoting transparency and accountability. With the establishment of this new authority, Gibraltar is poised to set a positive example for other countries in the region.
