High Court Outlines Considerations and Arrangements for Listed Entities
The High Court of Trinidad and Tobago has outlined the considerations and arrangements that can be made by listed entities under Section 5 of the respective Economic Sanctions Orders (ESOs).
Designated Entities
A designated entity is an individual or entity, and their associates, designated as terrorist entities by:
- The Security Council of the United Nations
- The 12267, 1989 and 2253 Committee
- The 1988 Committee
Information on Listed Entities
The Financial Intelligence Unit of Trinidad and Tobago (FIUTT) and the Office of the Attorney General and Ministry of Legal Affairs maintain a list of designated entities. The public can access this information by contacting:
- The Anti-Terrorism Unit at Level 21 AGLA Tower, Corner of London and Richmond Streets, Port of Spain
Applications for Arrangements
Listed entities may apply to the High Court for arrangements to permit financial transactions or other dealings with their property. Prior consent or non-objection from:
- The United Nations Security Council
- Respective Sanctions Committee
is required for designated entities on one of the United Nations Sanctions Lists, including:
- 1718 (2006) List
- 1988 (2011) List
- 2231 (2015) List
- Resolutions 1267 (1999), 1989 (2011), and 2253 (2015) List
Procedure for Applications
To apply for arrangements, the listed entity must:
- Notify the Attorney General
- Serve a copy of the application on the Anti-Terrorism Unit
The High Court will consider the application and ensure that any required consent or non-objection from the United Nations Security Council or respective Sanctions Committee is obtained before granting the order.
Frozen Property
Unless the High Court makes arrangements within the initial prohibitory order or varies an order accordingly, all property of a listed entity remains frozen and any dealings with same are not permitted.
