Council Gives Green Light to Home Occupation Proposal

The Shire of Cocos (Keeling) Islands Council has approved a home occupation proposal at Lot 139 Nelson Mandela Walk, West Island in a unanimous decision. The proposal, deemed compatible with residential use in the area, will allow a family member to occupy the property without employing non-family members.

Details of the Proposal


  • The development will not exceed a floor area of 30 square metres and does not require public utility services beyond those normally provided in the Residential zone.
  • No potential adverse impacts are expected from the proposed development, but Council officers recommend making the approval subject to various conditions to ensure that the home occupation does not cause nuisance or degrade the amenity of the locality.

Conditions of Approval


To ensure compliance with the approved development, the following conditions have been imposed:

Mandatory Conditions

  • The development must be carried out only in accordance with the details of the application as approved and any approved plans.
  • Any additional development that is not in accordance with the approved application or condition will require further approval from Council.
  • The development must not cause nuisance or degrade the amenity of the locality in any way, including noise, light, odour, fumes, smoke, vapour, or other pollutant.

Additional Conditions

  • The home occupation permitted must not occupy an area greater than 50 square metres.
  • The applicant must not erect or display on the home occupation premises any sign with an area exceeding 0.2 square metres.

The approved development will be subject to the terms and conditions outlined above, and Council officers will monitor the site to ensure compliance. A permit under the Food Act 2008 (WA) must also be obtained before the use can commence.
