Italy Battles Growing Epidemic of Identity Theft and Financial Crime

A Growing Concern

Cyber criminals are increasingly resorting to identity theft, stealing personal data with the aim of committing illegal acts in the victim’s name. This crime was previously punishable under Article 494 of Italy’s Criminal Code, but recent legislation has filled the gap by introducing stricter laws to combat digital identity fraud.

New Laws and Penalties

The new law, Decree Law 93/2013 converted into Law n. 119 of October 15, 2013, punishes computer fraud with:

  • Imprisonment from two to six years
  • Fines ranging from €600 to €3,000 if the act is committed using stolen or improperly used digital identities to the detriment of one or more individuals

The Problem with Identity Theft

The problem with identity theft is that victims may not even be aware of the crime until they suffer the consequences. Furthermore:

  • The widespread use of nicknames on social media
  • The sharing of personal information online make it increasingly difficult to attribute the crime to a specific individual.

Impact of Digital Identity Theft

The impact of digital identity theft goes beyond financial losses, as it can also have a significant psychological effect on victims. This includes:

  • Damage to an individual’s or company’s reputation
  • The need for individuals and companies to defend themselves against crimes they never committed

Protecting Online Presence and Personal Data

As technology continues to evolve, there is a growing need for quality and efficiency standards in online services provided by the state, companies, and individuals. Italian lawyers are urging individuals and businesses to take steps to protect their online presence and personal data.
