Cybercrime on the Rise in Jordan: New Law Aims to Combat Online Crimes

Introduction


Amman, October 16, 2023 - Jordan has implemented a new Cybercrime Law No. 17 of 2023, aimed at combating online-related crimes and addressing the growing threat posed by cyberattacks and digital offenses.

The New Law


The law, which came into effect on September 13, 2023, replaces the country’s old 2015 cybercrime law and comprises 41 articles. The new law introduces significant changes to tackle various types of online crimes, including:

  • Unauthorized access to information networks, software, accounts, and websites
  • Spreading misinformation and hate speech through online platforms
  • Phishing schemes designed to obtain financial or banking information
  • Creating fake social media profiles
  • Promoting prostitution and pornography
  • Distributing weapons-making instructions

Key Provisions


The Cybercrime Law includes several key provisions:

  • Article 12: Online Anonymity: It is illegal to circumvent IP addresses by using fictitious addresses or those belonging to third parties with the intention of committing a crime or preventing its discovery.
  • Article 25: Website Accountability: Website administrators are held accountable for illegal content published on their platforms.
  • Article 27: Participation in Online Crimes: Punishes anyone who intentionally participates in or incites online crimes.
  • Foreign Social Media Platforms: Requires foreign social media platforms with over 100,000 Jordanian subscribers to establish an office in the country to deal with local authorities’ requests and notices. Failure to comply may result in:
    • Ban on advertisements for 60 days
    • Reduction in internet bandwidth by up to 75% for 60 days
