The Malawi Sanctions Regulations, 2017 provide specific provisions and measures for enforcing United Nations sanctions. These regulations are designed to strengthen the country’s efforts to combat terrorism and other transnational crimes, and to implement United Nations sanctions effectively.

Key Provisions


  • Property Received or Credited into a Frozen Account: Property received or credited into a frozen account will be subject to specific provisions and measures contained in the regulations.
  • Prohibition of Entry or Transit: Individuals designated by the United Nations Sanctions Committee are prohibited from entering, transiting or remaining in Malawi, except for:
    • Malawian citizens
    • Individuals whose entry or transit is necessary for compliance with a judicial process
  • Restrictions on Arms and Related Materials: Dealings in arms and related materials are restricted, prohibiting supply, sale, transfer, carriage, delivery, training in or provision of technical assistance to designated persons.
  • De-Listing Application: A designated person may apply to have their name deleted from any list under the regulations on grounds including:
    • Mistaken identity
    • Relevant and significant change of facts or circumstances
    • Death
    • Dissolution or liquidation of a designated person
    • Any other circumstance that shows the basis for designation no longer exists

Immunity from Proceedings


The regulations provide immunity from proceedings against persons who effect or implement an order designating a person or freezing property or funds of a designated person in good faith under these Regulations.
