In a groundbreaking move, the Maltese government has introduced a comprehensive legal framework for blockchain and cryptocurrency businesses, aiming to strike a balance between innovation and regulation.
A Regulatory Framework for Blockchain and Cryptocurrency Businesses
The regulatory framework consists of three acts:
- Malta Digital Innovation Authority (MDIA) Act: Establishes a new authority responsible for promoting and regulating innovative technologies in Malta.
- Innovative Technology Arrangements and Services Act (ITAS Act): Sets out the regime for registering Technology Service Providers and certifying Technology Arrangements, including software and architectures used in designing and delivering blockchain technology.
- Virtual Financial Assets Act (VFAA): Provides a framework for Initial Coin Offerings (ICOs) and crypto exchanges, introducing specific requirements for whitepapers and clarifying the classification of distributed ledger technology assets.
The Virtual Financial Assets Act
The VFAA includes:
- Financial Instruments Test: Categorizes DLT assets into virtual tokens, financial instruments, or virtual financial assets.
- Whitepaper Requirements: Introduces specific requirements for whitepapers to ensure transparency and compliance.
