In a landmark move, Mauritania has enacted the Whistleblower’s Protection Law in 2018 with slight modifications and improvements in 2020. This law aims to provide a robust system of protections and incentives for whistleblowers who come forward with information about corrupt activities.
Key Provisions of the Law
- Protection from Harm: Whistleblowers are shielded from harm, including physical violence, acts of retaliation, and damage to their professional careers or reputations.
- Family members and employees of the whistleblower also receive protection under the law.
- Legal Assistance and Financial Compensation: Legal assistance and financial compensation are provided in cases where harm or damage is suffered.
Incentives for Whistleblowing
- Financial Incentive: Whistleblowers can claim a percentage (up to 5%) of the funds saved or recovered by the state if they have not been involved in the corrupt activity.
- Criminal Exemptions and Reduced Sentences: Criminal exemptions are granted to whistleblowers who disclose information prior to authorities discovering the act of corruption. A reduced sentence is also offered for those who come forward at a later stage.
