Mauritius’ Financial Regulator Introduces New Compliance Services Licence

Enhancing the Regulatory Framework

The Financial Services Commission (FSC) of Mauritius has announced a new licence for compliance services providers, aimed at strengthening the regulatory framework and ensuring the integrity of the financial sector.

Key Features of the Compliance Services Licence

  • Provides services such as:
    • Assisting with informing the FSC or any other authority in case of material breaches by companies
    • Monitoring returns provided to the FSC
    • Providing adequate training to officers on compliance issues
  • Must meet certain criteria, including:
    • Being physically resident in Mauritius
    • Employing staff with appropriate competence and qualifications
    • Having adequate resources and infrastructure
    • Maintaining a Professional Indemnity Insurance Cover

FSC’s Guidelines for Licensees

According to the FSC’s guidelines, licensees must also meet specific requirements, including:

  • A Board of Directors with at least two directors resident in Mauritius
  • Implementation of adequate internal controls and risk management policies
  • Compliance with regulatory laws and confidentiality standards

Why is this Licence Important?

By introducing this licence, the FSC aims to strengthen the regulatory framework and ensure that compliance services providers operate in a transparent and responsible manner. This will enhance confidence in the financial sector and protect the interests of investors and customers.

FSC Warns Against Outsourcing Compliance Functions

The FSC has also warned against outsourcing compliance functions to third-party service providers, except for certain licensees that are exempt from this requirement. These licensees include:

  • Management companies
  • Domestic long-term insurers
  • General insurers
  • Professional reinsurers
