A recent assessment by a team of experts has concluded that human trafficking and migrant smuggling pose a medium-level threat to the island nation of Montserrat. The report highlights the limited instances of human trafficking on the island, but notes that the context of Montserrat’s small size and remote location make it vulnerable to these criminal activities.
Tax Crimes: A Growing Concern
The assessment team also identified tax crimes as a concern for Montserrat, with nine pending cases related to tax offenses. To address this issue, the government has initiated stronger anti-money laundering/counter-terrorist financing (AML/CFT) frameworks and recruited new tax experts.
Drug Trafficking: Primary Threat
During the five-year period reviewed, cannabis was the primary drug smuggled into Montserrat. While strict AML/CFT legislation is in place to combat this threat, infrequent occurrences and relatively small quantities discovered resulted in a medium-level ML threat rating.
National Risk Assessment Highlights Key Vulnerabilities
The National Risk Assessment 2023 identified several vulnerabilities that Montserrat is addressing to ensure its AML/CFT systems align with international standards. These include:
- Quality and Accessibility of Intelligence Gathering and Processing: The report notes the need for improved data collection methods, intelligence gathering, processing, and distribution mechanisms.
- Quality of National AML/CFT Policy and Strategy: The absence of an approved national AML/CFT strategy was identified as a vulnerability, but a draft document is currently being prepared.
- Capacity and Resources of Investigation and Financial Crime Prosecutions: While the Office of the Director of Public Prosecutions (ODPP) has received training on prosecuting money laundering/terrorist financing cases, the assessment team recommends an increased need for human resources to ensure timely processing of cases.
Sector Assessment Highlights Susceptible Sectors
The assessment identified several sectors most susceptible to money laundering, including:
- Credit Unions: The sole credit union in Montserrat faces a medium-level money laundering risk, with a medium-low threat rating. The institution has implemented measures to enhance its security, including requiring large withdrawals to be made by cheque.
- Money Service Businesses: Montserrat’s three Money Service Businesses face a medium-level money laundering threat, based on their inherent attraction as a vehicle for all stages of the money laundering process.
- Domestic Banks: While domestic banks are subject to AML/CFT oversight, the assessment team notes that ongoing monitoring and improvement are necessary to mitigate the risk of money laundering.
- Real Estate: The real estate sector is also vulnerable to money laundering, as it provides a means for criminals to launder proceeds through property transactions.
- Legal Professionals: Legal professionals are susceptible to being used for money laundering purposes, particularly if they fail to properly identify and report suspicious transactions.
By addressing these vulnerabilities and strengthening its AML/CFT frameworks, Montserrat can better mitigate the risks posed by human trafficking, migrant smuggling, tax crimes, drug trafficking, and other financial crimes.
