The Special Law of the National Defense and Security Council

In 2011, a new superstructure with constitutional rank was approved in Honduras - the Special Law of the National Defense and Security Council (Ley Especial del Consejo Nacional de Defensa y Seguridad). This law created the National Defense and Security Council (Consejo Nacional de Defensa y Seguridad, CNDS), which is responsible for governing, designing, and overseeing general policies on security, national defense, and intelligence.

Composition of the National Defense and Security Council

The CNDS is composed of five key members:

  • The President of Honduras: The head of state serves as a member of the council, ensuring that national defense and security concerns are addressed at the highest level.
  • The President of the Supreme Court of Justice: The chief justice brings legal expertise to the council, providing guidance on matters related to law enforcement, judicial proceedings, and constitutional issues.
  • The Attorney General (Fiscal General): As the chief prosecutor, the attorney general plays a crucial role in overseeing the investigation and prosecution of crimes, ensuring that justice is served.
  • The Secretary of State in the Security Office (Secretario de Estado en el Despacho de Seguridad): This member brings specialized knowledge on security matters, enabling the council to make informed decisions on law enforcement strategies and policies.
  • The Secretary of State in the National Defense Office (Secretario de Estado en el Despacho de Defensa Nacional): As a member of the council, this official provides critical insight into national defense issues, ensuring that the country’s military capabilities are aligned with its security needs.

Responsibilities of the National Defense and Security Council

The CNDS is responsible for:

  • Determining the use of Security Tax funds: The council oversees the allocation of resources dedicated to national defense and security initiatives.
  • Coordinating police investigative units: By bringing together experts from various law enforcement agencies, the council ensures that investigations are conducted efficiently and effectively.
  • Promoting laws on judicial, criminal, security, and defense matters: The CNDS plays a key role in shaping legislation related to national defense and security, ensuring that policies are aligned with the country’s needs.
