A New Era in Azerbaijan’s Anti-Money Laundering Regulations
In a bid to strengthen its financial system and combat money laundering, the Republic of Azerbaijan passed new Anti-Money Laundering (AML) regulations on January 31, 2023. The new legislation, which took effect on February 1, 2023, seeks to bring more transparency and address illicit activities, replacing the previous law on the fight against the Legalization of Money or Other Property Obtained through Crime and the Financing of Terrorism.
Two New Laws to Enhance Azerbaijan’s AML Framework
The new regulations consist of two laws:
- “On the Prevention of Legalization (Laundering) of Proceeds Derived from Criminal Activity”
- “On the Counteraction to the Financing of Terrorism”
Key Focus Areas of the New Regulations
The new regulations aim to:
- Improve the identification and reporting of potential money laundering or terrorist financing activities
- Impose stricter penalties for non-compliance
- Increase cooperation with international partners
Scope of the New Regulations
The new regulations cover several key sectors, including:
- Financial institutions
- Designating professionals
- Other relevant businesses
These entities must:
- Conduct due diligence and know their customers
- Monitor and report any suspicious transactions
Establishment of the Financial Monitoring Service
The authorities have established a Financial Monitoring Service. It is responsible for maintaining and updating a list of Politically Exposed Persons (PEPs) and individuals and entities subject to financial restrictions or sanctions. This service will further aid financial institutions in managing their risks.
International Compliance
The new regulations are aligned with international standards, such as the Financial Action Task Force (FATF) recommendations. By implementing these measures, Azerbaijan is taking a proactive approach to adhere to international requirements and safeguard its financial system from potential threats.
In conclusion, the new anti-money laundering regulations in Azerbaijan mark a crucial step in enhancing the country’s financial system’s transparency and fighting illicit activities. These new regulations will bring about significant changes, and the businesses and professionals regulated under these laws must familiarize themselves with the new requirements to ensure continued compliance.
