SAMOA URGED TO ENACT WHISTLEBLOWER PROTECTION LAWS

The Public Service Commission has called on the Samoa Government to develop whistleblower legislation, a move that has been long overdue since its initial proposal in 2014. The commission’s Annual Review for the Public Administration Sector Plan 2013-2014 to 2017-2018 highlighted the importance of enacting such laws, citing the need for an anti-corruption body and good governance.

The Importance of Whistleblower Protection Laws

Whistleblower protection laws are crucial in fighting corruption and promoting transparency and accountability in Samoa’s public sector. These laws provide a safe and protected environment for individuals to report fraud and other irregularities without fear of retribution.

Audit Office Establishes Special Unit for Fraud Reporting

In the meantime, the Audit Office has taken a proactive approach by establishing a special audit unit dedicated to whistleblowers in the public sector who wish to report fraud and other irregularities. The unit was set up in accordance with the 2014 laws that recommended facilitating voluntary reporting of fraud and irregularities while providing legal protection for whistleblowers.

Unit Operations and Capacity Building

The special unit will be staffed by newly qualified certified fraud examiners, with plans to recruit legal and police expertise to cater to civil servants-turned-whistleblowers. The unit’s capacity building program includes C.F.E training, allowing staff to network and seek resources and expertise from the Association of Certified Fraud Examiners (ACFE) when needed.

The unit will employ a multi-faceted approach in its operations, including:

  • Risk assessment
  • Awareness activities
  • Education
  • Prevention and deterrence measures
  • Detection and identification
  • Investigation
  • Assistance with prosecution

Expected Success and Impact

The success of this initiative is expected to build on the cooperation and assistance received from various government ministries and offices. The establishment of this special unit will help create a culture of integrity and good governance in Samoa, promoting transparency and accountability in the public sector.

Conclusion

Experts believe that whistleblower protection laws are crucial in fighting corruption and promoting transparency and accountability in Samoa’s public sector. With the Audit Office’s efforts to establish a special unit for fraud reporting, it is hoped that these measures will help create a culture of integrity and good governance in the country.
