Nicaraguan Laws Regulate Public Sector Hiring and Judicial Careers

Managua, Nicaragua - A series of laws in Nicaragua have been put in place to regulate the hiring of professionals and technicians in public sector programs and projects, as well as the judicial career system.

Municipal Administrative Career Law (Articles 20-23)

The Municipal Administrative Career Law outlines the process for selecting candidates for public positions. The law stipulates that a public selection procedure must be carried out, consisting of tests indicated in the corresponding announcement. The competition is designed to assess the merits and experience of candidates, and only those who meet the skill level established for each eliminatory exercise will be graded.

Judicial Career Law (Law No. 501)

The Judicial Career Law sets a framework for the administrative and financial running of the judicial branch, regulates the judicial career, and ensures the prompt and correct administration of justice. The law is based on principles such as:

  • Merit
  • Responsibility
  • Equality
  • Disclosure
  • Stability
  • Impartiality
  • Independence

Under this law, the National Judicial Administration and Career Council is responsible for overseeing the enforcement of the Judicial Career Law and coordinating administrative and financial policies of the judiciary. The council also establishes the right of Nicaraguans to enter the judicial career regardless of:

  • Sex
  • Race
  • Political or religious beliefs
  • Any other factor other than personal merit and ability

Law Regulating the Hiring of Nicaraguan Professionals and Technical Services in Public Sector Programs and Projects Financed with Funds from Governments or International Agencies (Law 505)

This law regulates the hiring of professionals and technicians for public sector programs and projects financed by loans from national or international governments or agencies. The law requires that mechanisms set forth in the State Contracting Law be observed, including:

  • Registration in the Register of State Suppliers
  • Competitive bidding

Organic Law of the Public Prosecution Service

The Organic Law of the Public Prosecution Service sets down the method for appointing the Prosecutor General of the Republic, as well as his powers and grounds for removal. The law also establishes requirements for prosecutors in departments and autonomous regions, and for auxiliary prosecutors.
