Nauru Urged to Strengthen Integrity and Ethics Measures

A recent review of Nauru’s implementation of the United Nations Convention against Corruption (UNCAC) has identified several areas where improvements are needed to strengthen integrity and ethics measures in the country.

Key Findings and Recommendations

The International Cooperation and Public Affairs Committee (ICPAC) conducted a review, which noted that while Nauru has made progress in implementing UNCAC provisions, there are still gaps and challenges that need to be addressed. The key areas identified for improvement include:

  • Regulation of Funding for Elected Public Office: The review recommended that Nauru consider amending its Electoral Act 2016 to address the issue of funding for candidatures for elected public office.
  • Reporting of Suspected Acts of Corruption: The review suggested that Nauru establish measures or systems, including through legislation, to facilitate reporting of corruption to appropriate authorities. This includes hotlines and anonymous online reporting.
  • Conflict of Interest Systems: The review highlighted the need for stronger conflict of interest systems in place for public officials, including Members of Parliament. It recommended that Nauru enforce its existing system and consider extending it to other public officials.
  • Public Procurement System: The review noted that Nauru’s public procurement system needs to be strengthened to ensure transparency and accountability. This includes providing public information on procurement procedures, tendering rules and criteria, invitations to tender, and information on the award of contracts.

Technical Assistance Needs

The review identified several technical assistance needs, including:

  • Office of the Ombudsman: Financial assistance is needed to establish the office.
  • Office of the Auditor General: Technical and financial assistance is required to boost its functions and operations.
  • Ethics and Integrity Training: An independent expert should be hired to conduct training on ethics and integrity for public servants.

Asset Recovery

The review noted that Nauru’s framework for asset recovery can be found in part 7 of the Mutual Assistance in Criminal Matters Act 2004. However, it recommended that Nauru consider strengthening its asset recovery mechanisms to ensure effective recovery of stolen assets.

International Cooperation

The review highlighted several areas where international cooperation is necessary, including:

  • Mutual Legal Assistance: Agreements are needed to facilitate the exchange of information and evidence in criminal matters.
  • Extradition Agreements: Agreements are required to enable the extradition of individuals wanted for crimes committed in Nauru.

Conclusion

The review emphasized the importance of strengthening integrity and ethics measures in Nauru’s public administration to prevent corruption and promote transparency and accountability. By addressing these areas, Nauru can improve its implementation of UNCAC and contribute to a more transparent and accountable public sector.
