Providing Material Support to Terrorism

Overview

Section 2339C of the United States Code deals with crimes related to providing material support to terrorism. This section is part of Title 18, which covers crimes and criminal procedure.

Definition of Terrorism

  • The term “terrorism” refers to any activity involving an act or threat of bombing, using a weapon of mass destruction, or resulting in the death or serious bodily injury of any person.

Material Support

  • Providing Services: This includes offering support such as training, expert advice or assistance, safe houses, and other forms of assistance.
  • Goods: Providing material resources like money, food, shelter, transportation, communications equipment, clothing, arms, explosives, and medical supplies.
  • Resources: Offering facilities, including financial, technical, and personnel resources.

International Conventions and Treaties

The section recognizes several international conventions and treaties related to terrorism, including:

  • The International Convention for the Suppression of Terrorist Bombings
  • The International Convention for the Suppression of the Financing of Terrorism

These agreements aim to prevent and punish individuals and organizations that provide material support to terrorist activities.

Civil Penalty

Legal entities located within the United States or organized under its laws are liable for a civil penalty of at least $10,000 if their management or control has committed an offense related to providing material support to terrorism. This measure aims to deter organizations from supporting terrorist activities.
