Togo’s Strict Maritime Policy

Marseille, France - In a bold step against maritime infringements, Togo’s Customs Authorities have intensified their role and are imposing massive fines on vessels and their crews. This no-tolerance approach, applicable to both local and foreign nationals, has recently gained significance in Lome as the Customs Authorities assume new responsibilities.

New Responsibilities for Customs Authorities

With the Maritime Police now dealing solely with the establishment of infringements, Togo’s Customs Authorities are now responsible for issuing infringement notices and calculating penalties. The Togolese Customs Code allows for fines equal to four times the value of the seized goods and imprisonment for up to three years.

Recent Fines and Consequences

In the last month, at least three vessels have been fined substantial sums for seemingly minor infringements. Fines are calculated based on the vessel’s value, with additional taxes and other charges pushing the figures beyond €100 million. These fines prevent the vessels from sailing until they are settled.

Confiscation of Goods

Article 361 of the Togolese Customs Code states that confiscated objects, means of transport, and used concealment items are subject to confiscation, in addition to fines and imprisonment. This policy has resulted in significant financial consequences for vessel owners and operators.

Advice for Masters and Crew Members

Masters and crew members are advised to liaise with their ship’s agent for any vessel requirements or purchases to avoid inadvertent infringements. Engaging in illicit trade or smuggling while anchored is strictly prohibited. In case of any doubts, the ship’s agent or P&I correspondent should be contacted immediately.
