Whistleblower Protection: New Channel for Reporting Protected Disclosures Launched

Ireland’s Workplace Relations Commission (WRC) has launched a new external channel for reporting protected disclosures, providing a secure and confidential platform for workers to report wrongdoing in the workplace.

Reporting Process

To make a protected disclosure, workers can submit their report online or by post. Upon receipt of the report, the designated person will:

  • Acknowledge receipt within seven days
  • Notify the reporting person of the outcome of the investigation within six months (or additional time for complex cases)
  • Provide feedback within three months of the date of acknowledgement (or six months for complex cases)

Confidentiality and Data Protection

The WRC is committed to maintaining the confidentiality of the reporting process. The identity of the whistleblower and any other individuals concerned will not be disclosed without their consent, except in limited circumstances outlined in the Protected Disclosures Act.

  • Personal data provided in the reported disclosure will be processed in accordance with data protection law, including the General Data Protection Regulation.
  • The WRC has a lawful basis for collecting and processing personal data and will only collect data relevant to handling the report.

Offences and Penalties

It is an offence under the Act to:

  • Hinder a worker from making a report
  • Bring vexatious proceedings
  • Report false information or breach confidentiality

These actions can result in penalties, highlighting the importance of adhering to the protected disclosure process.

Conclusion

The WRC’s new external channel for reporting protected disclosures is designed to provide workers with a safe and confidential means of reporting wrongdoing in the workplace. If you have concerns about misconduct or other serious wrongdoings, contact the WRC today.
