Relaxed Zoning Rules for Cocos (Keeling) Islands
The Shire of Cocos (Keeling) Islands has relaxed its zoning rules to boost economic development and enhance the quality of life for residents.
Changes to Zoning Rules
The new rules allow existing non-conforming uses to continue, provided they do not have a significant impact on the surrounding environment. Additionally, the local government may grant development approval for changes to non-conforming uses if the proposed use is deemed less detrimental to the locality than the original use.
Incidental Uses
The zoning table has been extended to include incidental uses that do not alter the predominant use of the land. For example:
- A dwelling within an industrial zone can be used for residential purposes as long as it does not change the overall character of the area.
- Other examples may include:
- A small business operating from a residential property
- A hobby or activity being conducted from a commercial property
Special Use Zones
Special use zones have been introduced to cater to specific needs and activities. These zones are designated in Schedule 2 of the zoning scheme and require compliance with specific conditions set out in the schedule.
Development Application Process
Any changes or extensions to non-conforming uses must be approved through a development application process, which includes notice under clause 64 of the deemed provisions. The council will also have special regard to the impact on the preservation of the amenity of the locality when considering such applications.
